Terms of Service

Agreement to Terms

By creating an account or using Evergreen, you agree to these Terms of Service and our Privacy Policy. Continued use constitutes ongoing acceptance.

Eligibility

You must be at least 18 years old to use Evergreen.

Your Account

You're responsible for maintaining the security of your account credentials and passphrase. Your passphrase is used to derive your personal encryption key client-side. We never see or store it on our servers.

If you lose your passphrase, your data is permanently irrecoverable. We cannot help you recover it. No one can.

What Evergreen Does

Evergreen pulls from your personal data to train a preference-aligned AI model for you. Your model runs in a Trusted Execution Environment (TEE) that we cannot access. All personal data is encrypted at rest with a key derived from your passphrase.

Beta Status

Evergreen is currently in beta. The service, these terms, and our privacy policy are all subject to change without notice. Features may be added, modified, or removed. The service may experience downtime or be discontinued.

Acceptable Use

You agree not to:

  • Use Evergreen for any illegal purpose
  • Attempt to circumvent our security measures
  • Interfere with or disrupt the service
  • Use automated systems to access the service (except approved integrations)
  • Violate any applicable law or regulation

AI-Generated Content

Evergreen can generate content, compose emails, and create documents on your behalf. You understand that:

  • AI output may be incorrect, inappropriate, or harmful
  • You are solely responsible for reviewing all AI-generated content before sending, publishing, or acting on it
  • Emails are only sent and documents are only created when you explicitly trigger these actions
  • We are not liable for any consequences of AI-generated content

Intellectual Property

Your data is yours.

We claim no ownership over your personal data, connected service content, or AI-generated outputs.

Our service is ours.

Evergreen's software, design, and infrastructure remain the property of Workshop Labs. You receive a limited, non-exclusive license to use the service.

Third-Party Services

Your use of Google services through Evergreen is also subject to Google's Terms of Service. You're responsible for compliance with both.

Termination

By you:

You can delete your account at any time. All your data is permanently deleted. OAuth tokens are revoked. We retain only anonymized logs and metadata required for legal/operational purposes.

By us:

We may terminate or suspend your account for:

  • Violation of these terms
  • Violation of applicable law
  • No reason during the beta period with reasonable notice

Disclaimers

Evergreen is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • The service will be uninterrupted or error-free
  • AI outputs will be accurate, appropriate, or fit for any purpose
  • Your data will never be lost (though we take extensive precautions)

Limitation of Liability

To the maximum extent permitted by law, Workshop Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill.

Our total liability for any claim arising from these terms or your use of Evergreen is limited to $100.

Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco, California.

Changes to Terms

We may update these terms at any time. During beta, changes may occur without notice.
